Dear Senator, I'm writing to urge you to oppose New Jersey Senate Bills S1292 and S2937. These bills adopt the IHRA definition of Anti-Semitism, which conflates criticism of Israel with hate against Jewish people. The bills will weaponize allegations of anti-Semitism to advance a political agenda and suppress advocacy for Palestinian Human Rights. We echo the sentiments of our Jewish allies who demand that their faith, Judaism, not be conflated with the inhumane policies of Israel. While this definition claims to focus on the well-being of Jewish folx, seven of the 11 examples in the IHRA definition relate to Israel and criticism of Israel. Scholars and Advocacy organizations across the globe, including Israel's largest human rights group B'TSELEM, have disputed the IHRA definition. Though the objective of passing IHRA is framed as an effort to fight antisemitism, the most prevalent use of this definition is the suppression of non-violent protest, activism, and criticism of Israel and Zionism. According to the ACLU, the most common targets of IHRA-based attacks have been university students, professors, and grassroots organizers over their speech and activism on Palestinian freedom. The ACLU has stated, “Indeed, regardless of the original intent of its drafters, in practice, the IHRA definition has been used consistently (and nearly exclusively) not to fight antisemitism, but rather defend Israel and harm Palestinians – at the cost of undermining and dangerously chilling fundamental rights of free speech, freedom of assembly and protest, and academic freedom.” S1292 would allocate $100,000 of taxpayer money for a public campaign to promote this weaponization of false anti-semitism accusations. Our communities are in dire need of resources, better infrastructure, and more. You are expected to spend public funds with care, not carelessness. Our State government should prioritize combating Anti-Semitism and Islamophobia; however, S2937 is a disingenuous effort to do so. By using the IHRA definition of anti-semitism this body will actively cause harm to many New Jersey residents. With over 40,000 Palestinians murdered, nearly 100,000 Palestinians injured and 90 percent of Gazans displaced in the past eight months at the hands of Israel, advocates for Palestinian human rights must not be silenced or criminalized. Adopting this definition will position New Jersey on the wrong side of history. The NJ governing body has a duty to serve its residents, not to do the bidding of foreign nations, especially ones that are engaging in genocide and violating both U.S. and international law. We urge you to fiercely and publicly express the firm belief that all political speech, including criticism of any government or ideology, is, and must remain, constitutionally protected. I respectfully urge you to vote no on S1292 and S2937. Thank you for your consideration.
